What is Proposition 65?

Proposition 65 is a California law that requires businesses to provide warnings about products that may expose consumers to any of more than 900 chemicals identified by the State of California — even at trace levels far below federal safety limits. It does not ban any product; it only requires a notice. These warnings are common in California, appearing on foods, supplements, coffee, cookware, and even in restaurants and parking garages. California is the only state that requires them.

Why do GEM Bites carry this warning?

GEM Bites are made from real, whole foods — dates, seeds, oats, cacao, algae, and other plants grown in soil. Like all plants, they absorb minerals from the earth: the nutrients we want, and also trace amounts of naturally occurring elements like lead that are present in soil, air, and water everywhere. This is true of virtually all whole foods — leafy greens, root vegetables, chocolate, and spices all contain trace levels for the same reason. It isn’t a manufacturing defect or contamination; it’s the nature of food grown in the ground.

Because California’s warning thresholds are set extremely conservatively — for lead, more than 1,000 times below the lowest level associated with observable effects — a real-food product can require this notice while remaining well within U.S. FDA safety standards.
